I am a trial lawyer with a broad civil practice including litigation of complex cases involving environmental remediation, fraud, breach of fiduciary duty, failed joint ventures, development and distribution agreements, trade secrets, unfair competition and breach of contract in numerous industries, from petrochemicals and hazardous waste to computer peripherals, insurance, construction, utilities and telecom.
I am particularly adept at preparing technical expert witnesses for trial testimony, presenting them and cross-examining opposing experts, including forensic accountants in financial fraud/breach of fiduciary duty cases and hydrogeologists, engineers and toxicologists in environmental remediation, toxic tort and construction development cases. I relish the challenge presented by dealing with lay witnesses with "skeletons in the closet" and poor presentation skills as well as attacking the best, most polished opposing witnesses.
I was brought up in the legal profession at a time (and with the best mentors in firms) that valued the ability to work up and try a wide variety of cases in many industries. Because of this, I bring a unique ability to see new cases from different perspectives. I pride myself on my ability to quickly get up to speed in new industries, presenting novel claims and distilling complex concepts (and challenging fact patterns) into a simple, focused story that any jury or judge can understand and accept.
I pride myself on my ability to come into a case at the eleventh hour, work collegially with existing counsel, review the existing lay depositions and critical documents, take and defend the critical expert depositions and try or arbitrate the case.
If what you want is a "one-size fits all" or programmatic approach to trying a case, I am not the lawyer for you. Likewise, if you want a specialist that has exclusively litigated and tried the same type of case for decades, I am not for you. If you want someone simply to "work up the case" for settlement, you would be better off elsewhere. But if you want a new take on your most challenging, bet-the-company case, by a seasoned trial attorney who relishes the battle and will give his all for your cause, I may be the right choice.
After thirty years in big and stellar boutique law firms, in March 2021 I opened my California office and added Colorado in 2023.
